Service description

TellWell (“the Service”) is an AI-powered platform that enables businesses to collect customer testimonials and conduct employee exit interviews through conversational AI. The Service includes AI-guided interview conversations, automated extraction of structured testimonials, public testimonial walls, embeddable widgets, and dashboard management tools. By creating an account or using the Service, you agree to these terms.

Accounts

• You must provide a valid email address to create an account.
• You are responsible for all activity that occurs under your account.
• You must not share your magic link authentication emails with others.

Acceptable use

You agree not to use TellWell to:

• Collect fraudulent, fabricated, or misleading testimonials.
• Harass, intimidate, or coerce respondents into providing responses.
• Collect personal information from respondents beyond what is necessary for testimonial or exit interview purposes.
• Violate any applicable laws, regulations, or third-party rights.
• Send interview links as unsolicited spam or bulk messages.
• Attempt to circumvent usage limits, rate limiting, or other Service restrictions.
• Reverse-engineer, scrape, or interfere with the Service infrastructure.

You are responsible for obtaining appropriate consent from respondents before sharing interview links. Respondents must participate voluntarily.

AI-generated content

The Service uses AI (Anthropic's Claude) to conduct interview conversations and extract structured testimonials from responses. AI-generated content (summaries, tweet-style quotes, case study snippets) is derived from respondent inputs and may not perfectly represent their intent. You are responsible for reviewing and approving all testimonials before publishing them.

Content ownership

• You retain ownership of your project configurations and the testimonials you collect.
• By publishing testimonials to a public wall or embed widget, you represent that you have the right to display the respondent's name, company, and feedback publicly.
• We do not claim ownership of your content but require a license to host, display, and process it as part of providing the Service.

Billing and subscriptions

• The Service offers free and paid plans. Plan limits (testimonials per month) are enforced automatically.
• Paid subscriptions are billed monthly through Stripe. You can cancel at any time from your dashboard billing page.
• Upon cancellation, your subscription remains active until the end of the current billing period. No partial refunds are issued for unused time.
• Refunds for other circumstances are handled on a case-by-case basis.

Account termination

We reserve the right to suspend or terminate your account at any time if you violate these terms, engage in abusive behavior, or use the Service in a manner that harms other users or the platform. We will make reasonable efforts to notify you before termination, except in cases of severe or illegal misuse. You may delete your account and associated data at any time by contacting us.

Service availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service downtime.

Limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, TellWell and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Changes to these terms

We may update these terms from time to time. Changes will be reflected on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the updated terms. For significant changes, we will make reasonable efforts to notify you via email.
